1. Overview
These Terms & Conditions (“Terms”) govern your purchase of products from our online shop. By placing an order, you agree to these Terms. If you do not agree, please do not use our services.
2. Products & customisation
- We offer standard products and custom branded products (e.g., printed/embroidered items or items made to your specifications).
- For custom branded products, you confirm you have the right to use any artwork or branding you supply and you grant us a non-exclusive licence to use it solely to fulfil your order.
- Minor variations in colour/placement may occur due to manufacturing processes and display differences.
3. Pricing, payment & invoicing
- Prices are shown in South African Rand (ZAR) and include/exclude VAT as indicated at checkout.
- We accept secure online payments via CallPay. By paying, you authorise us and CallPay to process your payment.
- Invoices/receipts are generated and issued via Sage after successful payment.
- We may correct pricing errors and cancel/refund orders affected by an obvious mistake.
4. Order process
- Your order is an offer to buy; acceptance occurs when we confirm dispatch (or when we start customisation for custom items).
- We may decline an order (e.g., due to stock limits, artwork concerns, or suspected fraud) and will refund any payment received.
5. Delivery
- Custom branded products: dispatched within 3–5 business days after customisation is finished.
- Non-custom products: delivered within 3–7 business days from order confirmation, subject to courier serviceability and stock.
- Delivery timelines are estimates. We’ll keep you informed of delays outside our control (e.g., courier disruptions).
- Risk passes to you on delivery. Please inspect parcels on arrival and report visible damage to the courier and us within 48 hours.
6. Returns & refunds
- 14-day return policy (cooling-off) for non-custom products only: You may return eligible items within 14 days of delivery for a refund or exchange, provided items are unused, in original packaging, and in resellable
condition. You are responsible for return shipping unless the item is defective or incorrectly supplied.
- No returns on custom branded products except where defective, damaged in transit, or not as per the approved proof/specification. We’ll repair, replace, or refund as appropriate.
- To start a return, contact support@dsignx.co.za with your order number and reason. We’ll provide return instructions.
- Refunds are processed to your original payment method after inspection. Please allow 5–10 business days after we approve the return.
7. Artwork approval for custom items
- We may provide digital proofs. Production begins only after your written approval.
- Your approval confirms the final design; errors present in approved proofs (e.g., spelling) are your responsibility.
8. Warranties & quality
- Products carry the manufacturer’s warranty (if any). We warrant items to be free from material defects at delivery.
- Remedies for defective items: repair, replacement, or refund at our discretion, subject to inspection.
9. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential losses (including lost profits) arising from your use of our products or delays in delivery. Our total liability for any claim is limited to the
amount you paid for the relevant order.
10. Intellectual property
All site content and product designs we create remain our intellectual property. Your supplied branding remains yours; you grant us a limited licence to use it solely to fulfil your order.
11. Privacy
Your personal information is processed according to our Privacy Policy, including use of CallPay, Sage, and Mailchimp.
12. Force majeure
We are not responsible for delays or failures caused by events beyond our reasonable control (e.g., strikes, courier failures, load shedding, supply constraints, natural disasters).
13. Governing law & disputes
These Terms are governed by the laws of South Africa. If a dispute arises, the parties will first attempt to resolve it informally in good faith. If unresolved, either party may refer the dispute to a competent South African court.
14. Changes to these Terms
We may update these Terms from time to time. The latest version will be posted on our website with the effective date above. Orders will be governed by the Terms in effect at the time of purchase.
